The South Carolina Age-Appropriate Code Design Act (H.3431) applies to certain online services that conduct business in South Carolina, are reasonably likely to be accessed by minors under 18, determine the purposes and means of processing personal data, and meet specific business thresholds. 

Yes. Compliance with COPPA, GDPR, or other privacy laws does not satisfy the requirements of the South Carolina Age-Appropriate Code Design Act. H.3431 audit and reporting requirements. Organizations should assess their obligations under this law separately.

A covered online service generally includes an online platform, website, application, game, marketplace, or digital service that is reasonably likely to be accessed by minors under 18 and meets the thresholds established under South Carolina H.3431.
