allowing Privo to work with companies to ensure that they are meeting the legal requirements for marketing to
children in compliance with COPPA.
The Children's Online Privacy Protection Act (COPPA), effective April 21, 2000 applies
to the online collection or disclosure of personal information from children under the age of 13. The rule specifies
what a website operator must include in a privacy policy, when, how and for what purpose verifiable consent from a
parent must be obtained, and what responsibilities an operator has to protect children's privacy and safety
online.
COPPA applies to personally identifiable information about a child under 13 years of age,
that is collected online, such as full name, home address, email address, im, telephone number or any other
information that would allow someone to identify or contact the child. Additionally COPPA applies to non personal
information that is combined with any personally identifiable information as described above. (example: birthdate
combined with email address for use in a Birthday Club).
Most importantly, COPPA mandates that companies obtain verifiable parental consent before
allowing a child access to online community features such as chat or message boards where the child themselves could
disclose their own personal information.
