Denise Tayloe, President and CEO of PRIVO, was interviewed by Fox News on the issue of COPPA and changes coming soon...By July, Facebook, Google, Tumblr and others will likely be forced to remove photos, audio recordings or other personal identifiers of children -- or else face stiff fines, thanks to updates to a 15-year-old law.The Children's Online Privacy Protection Act (COPPA) was enacted in 1998. In 2011, the FTC beefed up the measure, preventing sites from collecting personal information from kids such as name, location and date of birth without a parent's consent.

President Barack Obama intends to designate Edith Ramirez as Chairman of the Federal Trade Commission effective Monday, March 4, 2013. She takes over for outgoing Chairman Jon Leibowitz, who has served in the position since March 2, 2009.
"I am deeply honored at the opportunity to lead the Federal Trade Commission. I look forward to working with my fellow commissioners and the able FTC staff to continue the agency's proud history of promoting vigorous competition and protecting consumers," Ramirez said. Ramirez became a commissioner of the FTC on April 5, 2010. At the FTC, she has focused on promoting competition and innovation in the technology and healthcare sectors, protecting vulnerable consumers from deceptive and unfair practices, and safeguarding consumer privacy.

Company also Will Pay $800,000 for Allegedly Collecting Kids' Personal Information without their Parents’ ConsentThe operator of the Path social networking app has agreed to settle Federal Trade Commission charges that it deceived users by collecting personal information from their mobile device address books without their knowledge and consent. The settlement requires Path, Inc. to establish a comprehensive privacy program and to obtain independent privacy assessments every other year for the next 20 years. The company also will pay $800,000 to settle charges that it illegally collected personal information from children without their parents’ consent. The settlement with Path is part of the FTC’s ongoing effort to make sure companies live up to the privacy promises they make to consumers, and that kids’ personal information isn’t collected or shared online without their parents’ consent.

Click here for more. - December 19, 2012 - FTC Strengthens Kids' Privacy, Gives Parents Greater Control Over Their Information By Amending Children's Online Privacy Protection Rule. Rule Being Modified to Keep Up with Changing Technology.
The Federal Trade Commission adopted final amendments to the Children's Online Privacy Protection Rule that strengthen kids' privacy protections and give parents greater control over the personal information that websites and online services may collect from children under 13.
The FTC initiated a review in 2010 to ensure that the COPPA Rule keeps up with evolving technology and changes in the way children use and access the Internet, including the increased use of mobile devices and social networking. The updates to the COPPA Rule reflect careful consideration of the entire record of the rulemaking, which included a public roundtable and several rounds of public comments sought by the agency.
Click here to read more... - December 10, 2012 - FTC's Second Kids' App Report Finds Little Progress in Addressing Privacy Concerns Surrounding Mobile Applications for Children. The agency reviewed 400 of the most popular children's apps available on Google and Apple platforms, and reported that only 20 percent disclosed their data collection practices.
FTC staff examined hundreds of apps for children and looked at disclosures and links on each app's promotion page in the app store, on the app developer's website, and within the app. According to the report, "most apps failed to provide any information about the data collected through the app, let alone the type of data collected, the purpose of the collection, and who would obtain access to the data. Even more troubling, the results showed that many of the apps shared certain information with third parties - such as device ID, geolocation, or phone number - without disclosing that fact to parents. Further, a number of apps contained interactive features - such as advertising, the ability to make in-app purchases, and links to social media - without disclosing these features to parents prior to download."

The operator of fan Web sites for the pop stars Justin Bieber, Selena Gomez, Rihanna and Demi Lovato agreed to pay a $1 million civil penalty to settle federal charges that the sites illegally collected personal information about thousands of children, the Federal Trade Commission said Wednesday.
In a complaint, the Federal Trade Commission said that Artist Arena, the operator of the sites, violated a children's online privacy rule by collecting personal details - like the names, e-mail addresses, street addresses and cellphone numbers - of about 101,000 children aged 12 or younger without their parents' permission.

Federal regulators are about to take the biggest steps in more than a decade to protect children online.The moves come at a time when major corporations, app developers and data miners appear to be collecting information about the online activities of millions of young Internet users without their parents' awareness, children's advocates say. Some sites and apps have also collected details like children's photographs or locations of mobile devices; the concern is that the information could be used to identify or locate individual children.
These data-gathering practices are legal. But the development has so alarmed officials at the Federal Trade Commission that the agency is moving to overhaul rules that many experts say have not kept pace with the explosive growth of the Web and innovations like mobile apps. New rules are expected within weeks.
"Today, almost every child has a computer in his pocket and it's that much harder for parents to monitor what their kids are doing online, who they are interacting with, and what information they are sharing," says Mary K. Engle, associate director of the advertising practices division at the F.T.C. "The concern is that a lot of this may be going on without anybody's knowledge."

Rep. Ed Markey, D-Mass., introduced the Mobile Device Privacy Act on Wednesday, aimed at bringing greater transparency to third-party tracking of consumer devices. The legislation follows last year's revelation that diagnostic analysis providers like Carrier IQ used software to collect certain user data from cellphones, including dialed phone numbers and visited URLs. The Federal Trade Commission will extend until September 24, 2012, the deadline for commenting on additional proposed modifications to the Children's Online Privacy Protection Rule, which gives parents control over what information websites and online services may collect from children under 13.
On August 1, 2012, the Commission published a Supplemental Notice of Proposed Rulemaking seeking comments on proposed modifications to the Children's Online Privacy Protection Rule with a deadline of September 10, 2012. In response to requests from several organizations, public comments on the Supplemental Notice of Proposed Rulemaking will now be accepted until September 24, 2012.

In light of massive changes in data-collecting technology over the last decade, the Federal Trade Commission has proposed a list of new rules to further clarify what information is unacceptable for companies to collect from kids online. The new restrictions are an attempt to update a 1998 law...
The most significant proposed changes to Coppa involve broadening the definitions of "personal information" and "operator" in the context of an online environment to cover newer web developments popular with children, such as chat rooms and video-sharing sites. In addition, the proposal extends liability to third-party companies gaining access to children through software plug-ins and embedded ad networks that operate within the larger framework of child-directed websites or apps.
"There's no law that says you can't market to children," said Denise Tayloe, chief executive of PRIVO, an Arlington, Va.-based firm that helps companies comply with Coppa. By eliminating some gray areas, Tayloe believes the new clarifications actually may help level the playing field for smaller web companies, which often can't afford to attract children via TV or other mass media. "This is a chance to have a permission-based relationship while shaking Moms hand at the same time."

The Federal Trade Commission is expected to announce Wednesday new rules that close loopholes that currently allow companies to gather information despite a 1998 law that was supposed to protect kids' online footprint...
...The largest penalty to date issued for a violation of Coppa came last May when Walt Disney Co. DIS -1.34% subsidiary Playdom agreed to pay $3 mi ion to settle FTC charges that on 20 websites it illegally collected and disclosed personal information from hundreds of thousands of children without parents' consent.
"How industry has treated this law all along is they have not embraced it," said Denise Tayloe, chief executive of Privacy Vaults Online, a McLean, Va., firm that consults companies on how to comply with Coppa. "They've looked for ways to scoot around it."

New Jersey Attorney General Jeffrey S. Chiesa and the state Division of Consumer Affairs have filed suit in federal court in Newark to stop an educational mobile app developer from collecting personal information from children, then passing on the information to marketers without telling parents.
The lawsuit -- the first lawsuit filed by the state under the federal Children's Online Privacy Protection Act (COPPA) -- names 24x7digital, LLC, the Los Angeles-based developer and operator of the "TeachMe" series of 99-cent apps for the iPhone, iPad and iPod Touch.
"We appreciate the educational component of these apps," state DCA Acting Director Eric T. Kanefsky said, "but under no circumstances is it acceptable to transmit identifying information about toddlers or first- and second-graders without the informed consent of their parents."
"TeachMe: Kindergarten" is currently Apple's 12th most popular education app, Kanefsky said.
